"Novolipetsk Iron & Steel Corporation" informs you on the auction for freedom of sales contract for an office block with extensions situated in Lipetsk, ul. Devyatogo Maya, 10.
The auction is scheduled for November 24th, 2003 at 10-00: Lipetsk, pl. Metallurgov, 2, r. 639.
The auction is run in accordance with the regulations concerning the closed bidding of the immovables of NLMK, confirmed by the order of the Director General of NLMK ь 507 dd. 24.07.2002.
The proprietor of the marketed object is NLMK, which is confirmed by the registration ь 48-01/20-07/2003-1730 in the Common State Register of the rights for the real estate and making deals with it on July 15, 2003.
Means of payment - Russian Federation currency (roubles).
Natural and juridical persons are allowed to participate in the auction if they apply for it in time and submit the duly filled documents in compliance with the list, given in this information message, and transfer the deposit on the accounts, specified below, not later than the final application day.
The application for participation in the auction submitted by the contender is registered by filling in the application and expresses the intention of the contender to take part in the auction on terms mentioned in this information message. This application is considered as contender's business proposal to enter into a sales contract of the real estate object.

No third person has any right for the property.
Initial price of the object - 1 500 000(one million five hundred thousand) roubles.
Deposit price - 300 000 (three hundred thousand) roubles. The auction commission of NLMK grants applications for participation in the auction from October 21th 2003, on working days only, from 8-00 till 17-00 to the following address: 398040, Lipetsk, pl. One contender must submit only one application.
The deadline for submitting applications is 16-00 (local time), November 21th 2003.
From the beginning of the application period every contender is given an opportunity to preliminary acquaint themselves with the information about the order of the preliminary examination with marketed object, sale and purchase terms
Up to the final application date for participation in the auction the contender has the right to withdraw his registered application by means of written notification of NLMK and sending a copy of this notification to the commission. In this case, the received sum of the deposit is due to be returned within 5 days when NLMK receives the notification on the withdrawal of the demand.
Participation documents:
To participate in the auction under the regulations "About the closed bidding of the immovables of "Novolipetsk Iron and Steel Corporation", confirmed by the order of the Director General of NLMK ь 507 dd 24.07.2002, it is necessary to render the following documents:
1 Application in accordance with a set form;
2 For juridical persons:
• Attested copies of the constitutive documents in accordance with a set order;
• Written permission of the corresponding administrative bodies of the contender, allowing to acquire a realty object (if necessary in accordance with the constitutive documents of the contender and state legislature, in which the contender is registered);
• Duly completed letter of attorney on the person competent to act on behalf of the contender-organization while submitting an application and signing the contract;
3 For natural persons - passport;
4 Signed by the contender list of the given documents in duplicate, on one of which ( the one remaining with the contender) the commission indicates the number of the application.
The stated documents, with regard to their content and infill, must fit with the requirements of the Russian Federation legislation. Corrected, blotted, erased documents will not be considered.
After submitting the application it is necessary to transfer the deposit on the settlement account ь40702810300000000309 of "Lipetskkombank", Lipetsk, INN 4823006703, BIC 044206704, correspondent account 30101810700000000704.
The deposit is due to be transferred to the account of NLMK until the final application day, determined by this information message.
The document, confirming the transference of the deposit on the account of NLMK is an abstract of NLMK's account. The contender is responsible for all the risks, connected with the transference of the deposit.
The contender is not permitted to participate in the auction if:
1 The submitted documents do not prove the right of the contender to be a buyer under the current legislation of Russian Federation;
2 The application is given by the person, who is not competent to do it;
3 Not all documents mentioned have been given or filled in properly;
4 The sum of the deposit, transferred on the account of NLMK, is less than the one indicated in this information message or it has been transferred after the set time;
5 The sum of funds, indicated in the application for participation in the auction, is less than the initial price of the object, indicated in this information message;
6 The payment document on the transference of the deposit doesn't have the application number.
This present list of grounds for denial the contender to participate in the auction is an exhaustive one.
After the application deadline for participation in the auction the commission makes the minutes about the results of accepting of application and signs them.
On the basis of the minutes about the results of application accepting and abstract of account of NLMK the commission determines the contenders (further "bidders") and allows them to take part in the auction.
The decision of the commission to acknowledge the contenders as bidders is formalized by the minutes of the determination of the bidders, in which date, minutes number, commission staff, present members of the commission, full name of the realty object, which is due to be sold, contenders, acknowledged as bidders, and the contenders which have been denied to participate in the auction with the grounds for the denial.
The contender acquires the status of a bidder after the members of the commission sign the minutes determining the number of bidders.
The contenders, who have been denied the admission to participate in the auction, are informed about the decision within not more than 5 days since the commission signs the minutes about the results of the auction by delivering and making them sign for the letter of the corresponding notification or by sending that notification by registered letter.
If there is only one contender the auction is considered invalid and frustrated.
After determination of the bidders the commission fixes the selling price.
The selling price is fixed as the highest one among the prices stated in the application of the contenders.
The selling price cannot be less than the initial one.
In case several applications have one and the same price, the winner is the contender who was the earliest to give in the application
The minutes about the results of the auction are duplicated, and signed by the members of the commission who are present at the meeting on the day when final decisions are made.
When the minutes about the final decision are signed, the contender, who according to the minutes has been acknowledged as the winner gets the right to make the purchase and sale deal of the realty object sold by the auction and in accordance with the terms indicated in the present message about the results of the auction.
If within 20 days after signing the minutes about the results of the auction the sales contract for the realty object sold by this auction cannot be entered due to winner's fault, the winner loses the right to purchase this realty object. In this case, the amount transferred by the winner is returned within 180 days since the date when the minutes about the results of the auction are signed.
The notification on the acknowledging the bidder as the winner is given to the winner or his competent representative against a receipt or is sent by registered letter within 5 days after the signing the minutes about the results of the auction.
The sales contract for the realty object is entered under the Civil legislation of the Russian Federation. The payment for the object is made at a time within 10 days after signing the sales contract. The proprietary right for the object goes to the buyer by the order fixed by the Russian Federation legislation and the sales contract after the full payment for the object.
The fact of payment is confirmed by the abstract of NLMK's account about the receiving funds in the amount and order indicated in the sales contract.
The deposit paid by Buyers is considered a part of the total payment.
In accordance with the sales contract, Buyers are responsible for all the costs connected with the transition of the proprietary rights.
Within 5 days after signing the minutes about the results of the auction, NLMK returns the following funds to all bidders:
1 Funds received from the contenders who have been denied the participation in the auction;
2 Funds indicated in the applications which have not passed the standards;
3 Funds indicated in all the applications in case the auction is considered invalid and frustrated.
